WITCHTICS TERMS OF SERVICE

General

1. Upon commissioning me, you agree that you have read and understand my terms of service.

2. I have the right to decline a commission for any reason without explanation, though it may be given. It is up to me what I want/do not want to work on, and failure to respect this will get you blacklisted and blocked.

3. I do not accept commissions from clients under the age of 18 under any sircumstance. If I am unsure, I will ask for identification and proof of age.

4. I do not collect, use, or share any personal information that is shared with me through private messages, payment method, etc. This includes but is not limited to your adress, phone number, real/deadname.

Payment

1. Payment should be issued within 72 hours of receiving the invoice, unless otherwise has been agreed upon. If you need more time, simply let me know.

2. Payment should be through USD and will happen through Paypal invoices or Ko-Fi.
- This system will be replaced by Stripe invoices very soon. More payment methods will also be added.

3. I do NOT accept payments in cryptocurrencies.

4. Full payment is required upfront unless otherwise agreed upon. No work will be provided until fully paid off. Payment plans on orders over $250 can be discussed with me.

5. Refunds are NOT offered AT ALL unless:
- I personally deem that I am unable to finish the work for any reason
OR
- I, for any reason, decide that I do not want to complete the work. This could be due to, but is not limited to: loss of motivation, focus on other work, personal issues with client.
If part of the work has already be completed, you will be refunded for what wasn't finished. If the project wasn't started, you will receive a full refund when possible.

WIPS, sketches and edits.

1. Wips and sketches are always provided throughout the process. Major corrections and changes must be requested during the sketch stages!

2. When the sketch has been approved I will move on to lineart. If you want any large edits done when the linework is completed, there will be a $15-$30 USD fee depeding on the size and difficulty of the change. If there was an error on my part, you will not be charged for the edit.

3. If you want any large edits made upon completion of a semi-render, you will be required to pay for the time it takes to adjust the piece, which is usually a lot.
It's highly encouraged that you take a minute to really look at the sketch before you give me the OK! Edits to flat colors are not as hard to complete, but I will still require payment for any changes done post linework.

4. If you decide later that you want your piece upgraded or edited, you are welcome to reach out to me and discuss this. If I still have the file for your commission, it is most likely possible, and you will receive a quote.

Queue and waiting time

1. My queue tends to be pretty long, so please have patience. During hectic periods of my life, the wait time can stretch anywhere between one to two months to get a sketch completed. You will be kept updated if anything gets in the way of me starting work on or completing your commission within a given timeframe, and I tend to check in with my clients quite often with updates.

My queue is public and accesible for anyone to view.

2. I do not complete commissions in any particular order. My art habits are often sperratic and confusing, and I will work on multiple pieces at once. Please keep this in mind when reaching out about a timeframe for your commission! I try to keep the gap between commissions fairly small, but certain pieces will take longer to complete than others.
3. For a fee, your commission can be assigned a deadline and placed at the top of the queue. The fee depends on the type of commission. I may not be able to accept every rush commission request, as certain pieces require more sketching and research time on my end.
Deadlines may be no shorter than:
Sketches - 2 days
Linework/Icons - 2 weeks
Flat colors - 2,5 weeks
Semirender - 4 weeks (Keep in mind I am very unlikely to accept this kind of rush commission.)

Rights and usage.

1. My art may not be used in any AI learning program under any circumstance.

2. My art may NOT be minted as/sold as NFTS.

3. I reserve full rights to my artwork by defaulf. I may share your commission and WIP pieces to any social media of mine, have it printed, used for advertising my art, and so forth. If agreed upon, I will keep the commission either
a) anon, which comes at no extra change for you. This means your name will not be put in the description, title, or in the case of physical products, in and/or on merchandise or other items.
OR
b) it will be patreon-only, which comes at a 200% fee. Unless otherwise is agreed upon when discussed, I gain the right to release the piece publically 20 years after it's completion. Your identity will not be revealed.

4. With proper credit given, you may:
- Use your commission as your avatar, banner, etc. on social media.
- Use your commission as a stream/youtube/channel devor etc.
- Print the art on a sticker, mug, shirt, etc. for personal use only!
- Repost the art you commissioned

5. Commissions for COMMERCIAL use do NOT use the same terms of service. Anything for commercial use must be discussed with me beforehand. This terms of service only applies to PRIVATE commissions.

6. You may NOT, under any sircumstance:
- Claim my art as your own
- Re-sell my artwork in any way (ex. on merch, art-sale websites, as prints, etc.)
- Edit my work without permission or remove my watermark
- Use the art you commissioned for any kind of commercial use or profit.
